Phillips has issued a recall for approximately 5.5 million CPAP devices due to potentially fatal defects. According to the company, the foam used in the respirators of these devices can break down over time and cause serious complications.

So far, there have been 44 deaths associated with this CPAP defect. Other complications include:

  • Respiratory and Breathing issues
  • Asthma and Pneumonia
  • Chest Pain and Cough
  • Dizziness
  • Nodules
  • Infection

Cancer has also been reported as a consequence of this defective product.

Recalls are intended to prevent future injury from a defective product. They do not protect a company from liability when a product has already caused harm. The manufacturer can be held liable for all related damages when a recall follows a serious or fatal injury. If you have been injured by a defective CPAP machine, talking to one of our attorneys can help you understand your rights and options.

CPAP devices treat sleep apnea, a common sleep disorder marked by periods of breathing cessation. When sleep apnea is left untreated, it can result in various issues, from minor inconveniences like chronic sore throat to more worrisome problems like increased risks of developing metabolic syndrome.

Mood disorders, memory and concentration problems, and dangerous levels of daytime fatigue are also common in individuals with sleep apnea. People suffering from fatigue are more likely to be involved in auto accidents as well, increasing the risks of this common disorder.

Patients turn to CPAP to address sleep apnea symptoms, improve sleep, and enhance their quality of life. When the device they turn to for help actually causes harm, patients are entitled to hold the manufacturer responsible for all related damages.
